Judge set to rule on new trial for convicted rapist Thursday afternoon

A Spokane County Superior Court judge is set to rule Thursday whether a former police sergeant convicted of rape will be granted a new trial.
Gordon Ennis was convicted of second degree rape. He has yet to be sentenced for the crime, having requested new counsel and asked for a new trial in the months since the jury handed down its verdict.
Last week, Judge Maryann Moreno heard arguments for and against a new trial for Ennis. Among the defense’s argument Friday was that Ennis’ trial attorney, Rob Cossey, didn’t use evidence that could have swayed the jury’s decision. Ennis is now represented by Mark Vovos.
If granted, this trial would be the third time Ennis faces a judge on these charges- the first trial in 2016 was declared a mistrial.
Moreno said last week that she would hand down her ruling will be handed down at a previously scheduled presentment hearing, originally set for Friday but pushed to Thursday afternoon.
A sentencing hearing in this case is still scheduled, pending the judge’s ruling, for August 24.
